Building an EB-1A Case: Six Steps You Can Take Now

If you're building toward an EB-1A in a technical field, here are 6 criteria you can actively work toward right NOW:

Here's what I tell clients who are building their profile over time:

(1) Write and publish

Even if your field isn't one where people typically publish a lot of scholarly articles, if there's an opportunity to write something and get it published in a professional publication, take it. It doesn't have to be dozens of articles. Even a couple can help you meet one of the criteria. And this is something you can actually control. You can write the article. You can submit it. As long as it's in a publication for people knowledgeable in your field and has the markers of scholarly work, it can count.

(2) Look into professional associations

Not every membership matters for these cases. If it's an organization you can join just by paying a fee, that's not going to help. What matters is whether the organization requires outstanding achievement to become a member. The best situation is when that's clearly stated in their bylaws or on their website, or when the organization is willing to explain their membership process in a detailed letter.

(3) Check your salary against the data

A lot of people assume their salary isn't high enough to count. But it's worth actually looking at the numbers. U.S. Department of Labor data, salary surveys, union rates if there's a union in your field. Sometimes people are surprised to find there's actually a strong argument when you compare their compensation to the available data.

(4) Look for opportunities to judge the work of others

This could mean reviewing for a publication or judging a competition in your field. If you're working on building your profile over a longer period of time, this is something you can actively pursue by reaching out to organizations in your field.

(5) Think about your original contributions carefully

This one has two parts. You need to show that your contribution is original, and you need to show that it's significant. Significant means it's having an impact beyond just your own work or your employer's work. The government wants to see that other people or companies are actually using what you created. They bought the product. They licensed it. They implemented it. That's how you show significance.

(6) Document your critical roles

If you've played an important role at a distinguished organization, think about whether you can get a detailed letter explaining why that role mattered. Not just what you did, but how it was important for the department or the organization as a whole.

None of this happens overnight. But if you're thinking about this path, there are steps you can take now that will make a difference later.
