The Biggest Immigration Mistake Right Now

The biggest mistake in immigration right now is treating it as if it hasn’t changed. I got a permanent resident case approved last week for a client who had been on a J-1 visa. I also recently had a J-1 visa applicant denied at the consulate.
Both things happened recently. And together they're telling me something I think clients should know.
A J-1 visa is a cultural exchange visa, but certain categories within the J-1 category allow qualifying applicants to work for a US employer for a limited period of time. I've been using those J-1 pathways successfully for years, allowing applicants and U.S. companies to achieve their goals.
But consulates are getting more difficult on these applications right now. What used to go through with relative consistency for qualified applicants is hitting more resistance. Since that J-1 denial, I am being completely honest with my clients about their chances of facing pushback at the Consulate and I am being more selective about which J-1 cases I'm willing to move forward with in the current climate.
For some clients, the right advice right now is to wait.
That's hard to hear when you're ready to move forward. But in a tightened environment, even strong cases carry more risk than they used to.
The immigration system is not static. Policies shift, enforcement priorities shift, and officers at consulates reflect those shifts in how they review applications. A strategy that was solid 18 months ago may need to be reconsidered now.
